Below are the stated guidelines for our valued customers, visitors, shoppers etc. We offer our service and permit you to use the website subject to your acceptance of the understated guidelines and to abide by the terms and conditions of this agreement.

This agreement is the legal agreement between you and the RuchiHealth that states the terms and conditions under which you may receive the Ruchihealth service and user the Ruchihealth.com website. Your use of the Ruchihealth.com service and the site constitutes your agreement to the terms and condition set forth below. If you do not agree to the terms and conditions do not use the Ruchihealth website or its services.

1. Ruchihealth Service:

1. Shopping and Online Service:

                                                i.      Local service: Ruchihealth employees, agents or designees will run shop and deliver the products placed with the Ruchihealth service.

                                                ii.    Delivery will be made to the delivery address that you specify when you place your order.

                                                iii.    Payment for the products delivered will be done at the time of delivery. The customer is responsible for ensuring that ‘an authorized person’ (a person above 18 years of age with proper identification) is present at the address notified with the shopping order to collect the delivery and pay for the goods.

                                    iv. It is clarified that the price indicated on the website is subject to change from time to time as per prevailing market rate.  In case, there is no change in the indicated price of the product at the time of receipt of customer's order, the price shall be deemed to be fixed and accepted by the customer.  If there is any change in the indicated price of any of the products, the revised price shall be communicated to the customer by e-mail and after confirmation of acceptance of the revised price by the customer by e-mail, the product shall be delivered to the customer.  The customer shall be bound to pay the price as per the invoice raised by the vendor/distributor/stockiest etc. at the date and time of delivery.

                                    v. For all necessary communication the buyer is required to provide correct email address at the time of registration. Ruchihealth.com or the Company shall not be responsible for any case of delay or non- communication in absence of valid and proper email address from the buyer.

                                                vi.    If Ruchihealth cannot deliver the goods at the address notified due to buyer’s negligence, the order shall need to be placed again at the local office or re-submitted at the website through feedback form with the order number duly specified.

                                                vii.     Ruchihealth’s liability for missing a delivery or pick up is limited to delivery at a later agreed upon time at no additional charge.

                                                viii.     Delivery within the 24 hrs or 48 hrs or the time specified accounts for the working days only. There shall be no deliveries on Sundays and other local and national holidays.

                                                ix.    If you are not satisfied with the products, you can always register your complaints at the website – www.ruchihealth.com/feedback.htm

                                               x.   While Ruchihealth strives to ensure that its online merchants will provide Ruchihealth customers with the highest quality items, however Ruchihealth shall not be liable for products’ quality, quantity, product availability and price discrepancies. All the discrepancies, guarantee/warranty and liabilities originating for the product quality, quantity, product availability and price discrepancies lie with the local vendors and merchants that provide the product.

                                                xi.      In case the product asked by you is not shown in the shopping cart for a particular city or cities, it can be separately asked for through the feedback form. Ruchihealth shall strive to provide the best and the most efficient service for availability of the product but does not assure or guarantee for the delivery of the same.

2. Information and the other website features:

                                                               i.      Ruchihealth strives to provide you the latest and the most detailed information for the its products and other services but does not endorse, warranty or guarantee of such products, information or services and is not liable for the accuracy, completeness or usefulness of such information, opinion or advice or the quality or availability of such products and services.

                                                             ii.      Ruchihealth will not be, in any manner, party to or in any way responsible for monitoring any transaction between you and the third party providers of products, services or information. Any separate charges/obligations you incur in your dealings with these third parties, are at your responsibility and are not to the account of Ruchihealth.

2. License and Proprietary rights:

1. All rights are reserved with Ruchihealth regarding website design, text, graphics, interfaces and the selection and arrangements thereof & all software. Permission is granted to view, electronically copy and to print in hard copy portions of this website for the sole purpose of placing an order with Ruchihealth for your personal, non-commercial use only. Any other use of material on this website, including the reproduction for purposes other than those noted above, modification, distribution or reproduction, without the prior written permission of Ruchihealth is strictly prohibited. Ruchihealth reserves the right to revoke this permission at any time and shall be discontinued immediately on written notice from Ruchihealth.

2. All Ruchihealth logos and all titles, characters, names, graphics and button icons are service marks, trademarks and or/trade dress of Ruchihealth or otherwise proprietary to Ruchihealth and shall not be used by you for any reason other than as expressly permitted by this Agreement. All other trademarks, service marks, product names, their packaging and color combination and company names or logos appearing in the Ruchihealth service are the property of their respective owners and Ruchihealth is not responsible for use of the same.

3. Except for the public domain material all other material is copyrighted. You may reproduce materials solely for your own personal use provided that you preserve any copyright and other proprietary notices contained in or associated with such information. You may not otherwise copy and may not distribute, publish, commercially exploit or otherwise transfer such material, in whole or in part, without the prior consent of the copyrighted owner. You acknowledge that Ruchihealth and/or third party content providers remain the owners of such material and that you do not acquire any of those ownership rights by downloading copyrighted material.

3. Customer registration Data; unauthorized use:

1. You agree to provide the accurate, complete and updated information as required by registration for the Ruchihealth Service (“Customer Registration Data”) including but not limited your legal name, billing and delivery addresses, telephone number, credit card number, expiration date and/or bank account information and promptly to notify of any unauthorized use of the Ruchihealth service or loss of theft of your credit card or change in bank account number.

2. You will remain liable for any use of the Ruchihealth service until you notify Ruchihealth of unauthorized use or loss or theft.

4. Fees, Payment and Access Expense:

1. You are responsible for, and agree to pay promptly, all charges to Ruchihealth, payable by you to your account, including applicable taxes etc. for the purchases made by you or anyone, including your children, relatives and other customers of your family or friends, you to allow to use Ruchihealth service.

2. All shopping expenses and various other charges will be assessed in accordance with the current Ruchihealth price schedule, which can be assessed online. If you fail to pay any expenses or any other charges when due under Ruchihealth payment schedule Ruchihealth may refuse to deliver the goods at the specified shipping address or levy the charges at the address where the goods have been delivered. The person receiving the goods shall be under an obligation to pay for the delivery. Ruchihealth also reserves aright to refuse or terminate your access to the Ruchihealth services. 

3. You shall be liable for any charges and collection costs, that Ruchihealth may incur in its efforts to collect any unpaid balances from you.

4. Your right to use the Ruchihealth services is subjected to limits established by Ruchihealth. If payment cannot be received for the goods delivered or a non-payment is returned to Ruchihealth for any reason, including charge back, Ruchihealth reserves the right to suspend or terminate your access to the Ruchihealth service and your customer account.

5. You will be responsible for all equipment and services and be responsible for all telephone and other charges necessary to access the Ruchihealth service.

6. You should contact your local telephone company if you have a question about the access to the Internet services in your area.

5. Changes in Agreement, Fee schedule and Ruchihealth service:

1. Ruchihealth may any time change any of these terms of this agreement or the Ruchihealth price schedule including changing the amount of, or basis for determining, the price structure or charges for the Ruchihealth service, and instituting new prices or charges. Ruchihealth reserves a right to make material changes to this Agreement or changes in any other schedule or schemes at the website without any prior notice. Users/ Customers for Ruchihealth services are required to review the terms of access on a periodic basis.

2. Ruchihealth may provide the highlighted changes in this Agreement but does not warrant or guarantee the same.

3. Disclaimer or Warranty: YOU EXPRESSLEY AGREE THAT USE OF THE RUCHIHEALTH SERVICE, THE SITE AND THE INTERNET IS ENTIRELY AT YOUR OWN RISK. THE RUCHIHEALTH SERVICE, THE SITE AND ITS CONTENTS ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS AND RUCHIHEALTH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO THE RUCHIHEALTH SERVICE, THE SITE OR ITS CONTENTS OR WITH RESPECT TO ANY INFORMATION, SERVICES AND PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE RUCHIHEALTH SERVICE AND RUCHIHEALTH DOES NOT ADOPT ANY REPRESENTATION OR WARRANTY OF ANY MANUFACTURER OR MERCHANT OF ANY SUCH INFORMATION, SERVICE OR PRODUCTS TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, RUCHIHEALTH DISCLAIM ALL SUCH REPRESENTATIONS AND WARRANTIES, INCLUDING BUT NOT LIMITED TO SERVICES, AND WARRANTIES AS TO THE AVAILABILITY, ACCUARACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES AND WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE OF INFORMATION, PRODUCTS OR SERVICES. RUCHIHEALTH DOES NOT WARRANT THAT THE FUNCTIONS PROVIDED BY THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THIS SITE OR THE SERVER THAT MAKES ITS AVAILBLE ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

4. The material in the Site is provided for lawful purpose only. Ruchihealth controls and operates from its headquarters at Mahakosh House, Indore (M.P.), India and makes no representations that these materials are appropriate or available for use in other locations If you use the Site from other locations, you are responsible for compliance with applicable laws. Price and availability of products is subject to change without prior notice.

6. Limitation of Liability:

1. Neither Ruchihealth nor any of its directors, employees, affiliates, agents, representations, third party information providers, merchants or licensors (collectively, “RUCHIHEALTH associates”) shall be liable for damages arising out of or in connection with the use of or the inability to use, the site or the Internet.

2. This is a comprehensive limitation of liability that applies to all damages of any kind, with respect to any other dispute arising from or relating to the Ruchihealth service, any liability of RUCHIHEALTH associates to you for damage losses and causes of action, whether in contract, tort (including negligence), or otherwise, either jointly or severally, shall be strictly limited to the shopping amount paid by you to Ruchihealth. Ruchihealth is not liable to pay any other additional expenses incurred to what-so-ever account thereof.

3. In no case shall Ruchihealth be liable for any compensatory, direct, indirect, consequential, special or incidental damages, loss of data, income or profit, loss of or damage to the property and claims of third parties arising from your use of the Ruchihealth service, the site, the internet or for any other claims related in any way to your relationship with Ruchihealth.

7. Indemnification: You agree to indemnify the RUCHIHEALTH associates to keep harmless, against any losses, damages and expenses, to be caused to Ruchihealth associates due to a violation of this Agreement by you or through use of your account.

8. Termination: Ruchihealth may suspend or terminate that Ruchihealth service at any time for any reason with or without notice to you. You may terminate your Ruchihealth service at anytime for any reason by delivering notice in a manner provided in this Agreement. The termination shall be effective from the day the notice is received by Ruchihealth or from the date as specified in the notice. If you terminate your Ruchihealth service for any reason you shall not be refunded any money for any shopping done through the site. Further, you shall be responsible for any charges incurred to the third party vendors or content providers prior to your cancellation.

9. Privacy policy: Your privacy policy is very important to Ruchihealth. Ruchihealth does not sell personal information about the individual customers (such as name, address, e-mail address) to third parties, sell or rent lists of customers or use information about individual customers outside the scope of Ruchihealth service.  Ruchihealth reserves the right to disclose aggregated information regarding its customers and usage of Ruchihealth service (such as customer demographics, tariff patterns etc.,) to advertisers, partners and others for various purposes.

10. Notices:  Ruchihealth may give notice to you of a change in this Agreement, a change in the content matter, the site, the discounts, new offers, or any other matter by general posting on the Ruchihealth website, by e-mail or by conventional mail to your address contained in the Customer Registration Data. You may give notice to Ruchihealth by email (as specified in the “feedback” section of the site), or by conventional mail to:

11. Legal and Miscellaneous: This agreement represents your entire agreement with Ruchihealth service and Ruchihealth website. You agree that this agreement is not intended to confer any rights or remedies upon any person other than you and Ruchihealth. If any portion of this Agreement is held invalid or unenforceable, that portion shall be construed in accordance with applicable laws nearly as possible to reflect the original intentions of the parties, and the remainder of this Agreement shall remain in full force and effect. The failure of either party to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. The Indian laws shall govern this Agreement. For the purpose of any litigation under this agreement you and Ruchihealth agree to submit jurisdiction to Indore (M.P.) courts only.

The conditions of clause numbers 6, 7 and 8 of this Agreement are for the benefit of RUCHIHEALTH Associates and each of them shall have the rights to assert and enforce the contract directly. Clause numbers 6, 7 and 8 of this Agreement and all obligations and restrictions placed upon you or your permitted users by this Agreement shall survive on termination of your Ruchihealth service.
